Cancellation and Return Conditions

CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), as well as other applicable laws regarding the sale and delivery of the purchased product.

3. Shipping costs, including the product shipping fee, will be paid by the buyers.

4. Each product purchased will be delivered to the person and/or organization at the address provided by the buyer, within 14 days, without exceeding the legal period. If the product is not delivered within this period, the buyer may terminate the agreement.

5. The purchased product must be delivered complete and in accordance with the characteristics specified in the order, along with any documents such as the warranty certificate, user manual, etc.

6. If it becomes impossible to sell the purchased product, the seller must inform the buyer in writing within 3 days from the time the seller learns of this situation. The total price must also be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID:

1. If the buyer does not pay for the product or cancels the payment through bank records, the seller’s obligation to deliver the product will be terminated.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

1. After the product has been delivered, if it is found that the credit card used by the buyer for payment has been fraudulently used by unauthorized persons and the payment for the sold product is not received by the seller from the related bank or financial institution, the buyer must return the product to the seller within 3 days, with the return shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

1. If force majeure occurs, which the seller could not foresee, and the product cannot be delivered on time, the buyer will be informed. The buyer may request the cancellation of the order, replacement with a similar product, or a delay in delivery until the obstacle is removed. If the buyer cancels the order, if payment was made in cash, the buyer will be refunded within 14 days. If the buyer made the payment by credit card and cancels, the payment will be refunded to the bank within 14 days, but it may take 2-3 weeks for the bank to transfer the amount to the buyer’s account.

BUYER’S OBLIGATION TO CHECK THE PRODUCT:

1. Before accepting the product/service subject to the agreement, the buyer must inspect it; damaged or defective goods, such as those with dents, cracks, torn packaging, etc., must not be accepted from the shipping company. It will be assumed that the product/service received is intact and undamaged. After delivery, the buyer must take care to protect the product/service. If the right of withdrawal will be exercised, the product/service must not be used. The invoice must also be returned along with the product.

RIGHT OF WITHDRAWAL:

1. The BUYER may exercise the right of withdrawal from the agreement by rejecting the product and notifying the SELLER within 14 (fourteen) days from the delivery date of the product to the buyer or the person/organization specified by the buyer, without assuming any legal or penal responsibility and without providing any reason.

RIGHT OF WITHDRAWAL PERIOD:

1. If the purchased product is a service, the 14-day period starts from the date of signing the agreement. If the service performance begins with the consumer's consent before the end of the withdrawal period, the right of withdrawal cannot be exercised for service contracts.

2. The costs arising from the use of the right of withdrawal are the responsibility of the SELLER.

3. To use the right of withdrawal, the buyer must notify the SELLER in writing through registered mail, fax, or email within 14 (fourteen) days, and the product must not have been used as per the terms defined in this agreement regarding the "Products on Which the Right of Withdrawal Cannot Be Used."

USE OF THE RIGHT OF WITHDRAWAL:

1. The invoice of the product delivered to the 3rd person or the BUYER must be returned. (If the product to be returned is an invoice issued by an institution, it must be sent with the return invoice issued by the institution. Returns of orders issued on behalf of institutions cannot be completed unless the RETURN INVOICE is issued.)

2. The return form, along with the product’s box, packaging, and any standard accessories, must be delivered complete and undamaged.

RETURN CONDITIONS:

1. The SELLER is obliged to refund the total price and return any documents that place the BUYER in debt within 10 days from the receipt of the withdrawal notice. The product must be returned within 20 days.

2. If the value of the product is reduced due to the buyer's fault, or if the return becomes impossible, the buyer is obliged to compensate for the damages of the SELLER in proportion to the fault. However, the buyer is not responsible for changes or deterioration due to the proper use of the product within the withdrawal period.

3. If the campaign limit set by the SELLER is lowered due to the use of the right of withdrawal, the discount amount used under the campaign will be canceled.

PRODUCTS ON WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

1. Products made according to the buyer’s request or clearly personalized, which cannot be returned, such as innerwear, swimsuits, makeup items, single-use products, goods that spoil quickly or have an expiration date, items that are unsuitable for return due to health and hygiene reasons after the buyer opens the packaging, products mixed with other products after delivery that cannot be separated by nature, goods related to subscription contracts, periodicals like newspapers and magazines, immediately performed electronic services, or intangible goods delivered to the consumer instantly, such as audio or video recordings, books, digital content, software programs, data storage devices, computer consumables, and opened packaging of these items, cannot be returned according to the regulation.

2. Cosmetics and personal care products, innerwear, swimsuits, books, copyable software, DVDs, VCDs, CDs, cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must remain unopened, untried, unspoiled, and unused to be eligible for return.

DEFAULT AND LEGAL CONSEQUENCES:

1. If the BUYER defaults on the payment process made by credit card, the cardholder agrees, declares, and undertakes to pay interest in accordance with the credit card agreement with the bank and be responsible to the bank. In this case, the bank may resort to legal actions, claim any incurred expenses and attorney fees from the BUYER, and in case of default, the BUYER agrees to pay the SELLER for any damages caused by the delay in payment.

PAYMENT AND DELIVERY:

1. You can make the payment via Bank Transfer or EFT (Electronic Fund Transfer) to any of our bank accounts (in TRY).

2. You can use online single payment or installment options with your credit cards on our website. The payment amount will be charged to your credit card at the end of the order.
