ARTICLE 1 - PARTIES

This User Agreement (“Agreement”) is electronically concluded between SEVDRUS, located at Serpil Sok. Kavacık Mah. Beykoz, the owner of the website sevdrus.com (“Website”), and all individuals (“Member”) using the Sevdrus products/services on the Website. From now on, the Company and the Member will be referred to as the “Parties.”

ARTICLE 2 - SUBJECT OF THE AGREEMENT

The subject of this Agreement is to define the terms and conditions under which the Member will use the products and services available on the Company’s Website.

ARTICLE 3 - ESTABLISHMENT OF THE AGREEMENT

The Member agrees that they have read and understood this Agreement, are aware of their rights and obligations, and accept them.

The Parties confirm that there is no disproportion in the obligations and the reciprocal actions under this Agreement and that the transactions covered by this Agreement are appropriate to the nature of the business. The Member accepts that they are fully informed about the benefits of the Agreement and agree to abide by all the terms freely, consciously, and without any coercion or hardship.

The Parties confirm that the provisions of this Agreement do not contain any unfair terms that would be deemed invalid under consumer protection laws. The Agreement has been prepared in accordance with the principle of good faith and honesty, ensuring fairness between the Parties.

The provisions of this Agreement have been prepared considering the Turkish Civil Code and the Consumer Protection Act. The Member affirms that they have reviewed and accepted the binding nature of this Agreement under Article 21 of the Turkish Civil Code.

ARTICLE 4 - MEMBERSHIP

Membership is acquired by completing the membership procedures on the Website (and accepting this Agreement).

The Member declares that they are at least 18 years old (or older) and understands and accepts this condition. If the Member is under 18 but at least 13 years old and has the mental capacity to understand the consequences of their actions, they may use the Website only with a parent or legal guardian. The Member also declares that their parent or legal guardian has reviewed and accepted this Agreement.

Members must provide accurate, truthful, and up-to-date information when registering for membership. This information may be updated or expanded as necessary by the Company. The Member is required to update any changes to their information in order to maintain active membership.

The Company may share the Member’s information with relevant authorities for regulatory or judicial purposes as required by law, and if no confidentiality order exists, the Member will be informed.

The Company may anonymously analyze Members’ personal information for promotional and statistical purposes.

Members can use a pseudonym (nickname) during registration, but it must comply with applicable law and ethical standards and must not contain offensive language, insults, or harmful expressions.

Members can cancel their membership at any time. To do so, the Member must notify the Company through the Website. Upon completion of the necessary procedures, membership will be terminated. The termination of membership will not affect the Member’s obligations or rights arising from this Agreement, especially those relating to compensations or legal obligations that remain in effect.

ARTICLE 5 - USE OF THE SERVICE AND FEES BY THE MEMBER

The Member may start using the products and services provided by the Website after completing the necessary registration steps and agreeing to the terms of this Agreement.

The Website can be accessed for free as a member.

The Company may, at its discretion, create promotional codes or campaigns related to its products and services. The Company will notify the Members if they have opted to receive such notifications.

Promotions and campaigns must not be misused by Members. If the Member is between the ages of 13 and 18 and has the mental capacity, they must obtain parental or legal guardian consent to participate.

Promotions and campaigns may be canceled at any time by the Company, without any claim for compensation from the Member.

ARTICLE 6 - RIGHTS AND OBLIGATIONS OF THE PARTIES

The Member agrees to provide true, accurate, and current personal information and to indemnify the Company for any damages caused by false or outdated information.

The Member’s account password and access to the Website are for the exclusive use of the Member. They are responsible for the confidentiality of their password and any legal or criminal consequences related to unauthorized access.

The Member cannot transfer their membership to another person. The Member agrees to comply with all applicable laws and regulations when using the Website.

The Member is prohibited from using the Website for unlawful purposes, and they must not engage in any activities that could harm the functionality or security of the Website.

The Company is not responsible for any unauthorized access or damage to the Member’s data.

The Member is solely responsible for any opinions, comments, or posts made on the Website. These are the Member’s personal views, and the Company has no responsibility for any resulting damages or legal issues.

OTHER PROVISIONS

The Website may link to other websites or applications, but the Company is not responsible for the content or services of these external sites.

The Member cannot transfer their profile or rights under this Agreement to third parties without the Company’s consent.

The Company reserves the right to suspend or terminate the Member’s membership at any time without notice or compensation.

All intellectual property rights related to the design, software, logos, and content of the Website are owned by the Company or licensed to it. Members are prohibited from using, copying, or altering these elements without the Company’s written permission.

The Company may disclose the Member’s personal information to third parties when required by law or with the Member’s consent, in accordance with the Privacy and Cookie Policies.
